These Terms of Use govern your use of datagets.ai and the free tools Datagets (“Datagets,” “we,” “us,” or “our”) provides on it, including Caliper at caliper.datagets.ai (together, the “Website”). By using the Website, you agree to these terms. If you do not agree, please do not use the Website.
1. Using the Website
- Only submit content you have the right to submit, and do not submit anyone’s confidential information without permission.
- Do not submit unlawful, infringing, or harmful content, and do not attempt to disrupt, attack, overload, or misuse the Website or its tools.
- Provide accurate information, including a valid work email address where one is requested.
2. Caliper
Caliper compares the email you submit against how leading brands in your category actually send, and returns a conformance score and benchmark report. It is a directional, informational benchmark. It is not a prediction or guarantee of open rates, click rates, deliverability, conversions, or revenue, and it is not professional or legal advice.
The full report is available after you verify a work email address at your brand’s domain. Each brand can have a limited number of verified addresses (currently 5); you can ask us for more access from within the tool. We may apply reasonable usage limits to keep the tool available for everyone.
3. Intellectual Property
You keep all rights to the content you submit. Datagets owns the Website, its tools, its benchmarks, and the format and methodology of its reports, and grants you a limited right to use your report for your own business purposes.
4. Privacy
Our Privacy Policy and Cookie Policy explain how we handle information you provide or that we collect when you use the Website, including Caliper.
5. No Warranty; Limitation of Liability
The Website and its tools are provided “as is,” without warranties of any kind. To the fullest extent permitted by law, Datagets is not liable for any indirect, incidental, or consequential damages, or for decisions you make based on a report.
6. Governing Law
These terms are governed by the laws applicable to Datagets’ place of incorporation, without regard to conflict-of-laws rules.
7. Changes to These Terms
We may update these terms from time to time. We will post the updated terms on this page with a revised “Effective date.”
